Terms of sale

1. Purpose and parties

These terms apply to every order placed on bobitech-cloud3d.fr or received from a connected store (Shopify, Etsy). The service is published by GLEAM, a SASU (French single-shareholder simplified joint-stock company) with share capital of €1,000, 42 Grande Rue, 01430 Saint-Martin-du-Frêne, France, SIREN 994 722 791 ("Bobitech").

The customer is the seller who has their items produced ("the seller") and acts for the purposes of their business. The end customer is the person who buys the item from the seller: they are not a party to the contract with Bobitech.

2. Orders

An order is placed on the site, or sent automatically when the end customer buys, in the seller's connected store, a product linked to a Bobitech model.

Every order is checked by the workshop before production. A file that cannot be printed correctly is rejected: the order is canceled and nothing is charged.

3. Files and rights

The seller warrants that they hold the rights to the 3D models they send or have generated, and that manufacturing and selling them does not infringe any third-party rights (intellectual property, trademarks). Bobitech uses these files only to manufacture the seller's orders.

Models in the "Ready to sell" catalog are offered under their creator's license, shown on each product page.

4. Prices

The price of each part is calculated by the price schedule shown on the site (material, volume, quantity, lead time) at the time of the order. For an order received from a connected store, this schedule applies, whatever retail price the seller sets for their customer.

Direct delivery to the end customer, in unbranded packaging: €7.90 per order. Delivery to the seller: €6.90 per order. Same rate for every country served.

VAT not applicable, article 293 B of the French General Tax Code (CGI).

5. Payment

Payment is made by card, through Stripe. The card is authorized when the order is placed and charged only when the workshop approves the files and starts production.

For orders from their connected stores, the seller saves a card and authorizes Bobitech to charge it the price of each approved order. An order whose payment is declined is not produced: it remains pending in the seller dashboard, where the seller can retry or dismiss it.

6. Production lead times

Shipping within 7 business days after approval, or 3 business days with the express option. These lead times are estimates; a delay does not give rise to compensation, except in case of fault by Bobitech.

7. Delivery

Countries served: France and the European Union, from the workshop in France; the United States and Canada, manufactured and shipped from Canada. An order bound for any other country is not produced.

The tracking number is sent to the seller and, for a connected store, reported to the store, which informs the end customer.

8. Seller responsibilities

The seller is solely responsible for their relationship with the end customer: retail price, information, customer service, right of withdrawal, returns and refunds.

The seller is solely responsible for the obligations related to their sales, including VAT and duties owed in the end customer's country, and for the compliance of the items they offer for sale.

9. Manufacturing defects

An item with a manufacturing defect or damaged in transit is reprinted and reshipped at no charge, or refunded, at Bobitech's option. The seller reports it within 14 days of delivery, with photos, to contact@gleamflow.fr.

Variations inherent to 3D printing (layer lines, slight differences in color or dimensions) are not defects.

10. Bobitech's liability

Bobitech's liability is limited to the amount of the order concerned. It does not cover indirect losses (lost profits, customer reviews).

11. Personal data

Data is processed in accordance with the privacy policy. For the data of their end customers, the seller is the data controller and Bobitech acts as a processor, solely to manufacture and deliver the seller's orders.

12. Governing law

French law. In the event of a dispute, and failing an amicable settlement, the courts with jurisdiction over GLEAM's registered office have jurisdiction.
